Terms of Service

The agreement between you and OptOutHQ. We kept it short and readable on purpose — a privacy company shouldn’t hide the ball in its own contract.

1. Agreement

By creating an account or using OptOutHQ (the “ Service”), you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

2. What the Service does

OptOutHQ helps you reduce junk mail, marketing email, robocall exposure, and data-broker listings. We do this by submitting opt-out and removal requests to third parties on your behalf, by operating an unsubscribe email alias for you, and by guiding you through opt-outs that legally require your own action. We act as your authorized agent for these requests where the law permits.

3. What we can and can’t promise

We will work diligently to submit and re-submit removals and to keep you opted out. But data brokers, senders, and registries are controlled by third parties: some ignore or delay lawful requests, some re-list people after a removal, and some require steps only you can complete. We therefore cannot guarantee that any particular listing will be removed, or removed permanently, or that you will stop receiving all unwanted contact. The Service is a best-effort agent, not a guaranteed outcome.

4. Your account and the information you give us

You must provide accurate information and are responsible for keeping your login credentials secure. You confirm that the personal information you submit is your own (or that you are authorized to act for the person it belongs to, such as on a Family plan), and you authorize us to disclose the minimum necessary fields to the opt-out targets you select. You must be at least 16 years old to use the Service.

5. Subscriptions, billing, and cancellation

  • Paid plans are billed in advance on a monthly or annual cycle through our payment processor, and renew automatically until cancelled.
  • You can cancel anytime from your account settings — cancellation is exactly as easy as signup. Cancelling stops the next renewal; it does not retroactively refund the current term except under the refund policy below.
  • 30-day refund: if you’re unhappy within 30 days of a new subscription charge, contact us and we’ll refund it, no questions asked.
  • We may change prices, but never for a term you’ve already paid for; founding-member pricing, once granted, is honored for as long as your subscription stays active.

6. Acceptable use

Don’t use the Service to submit information that isn’t yours or that you’re not authorized to submit, to break the law, to interfere with or attack the Service, or to abuse the unsubscribe alias for spam or harassment. We may suspend accounts that do.

7. Our commitment: we will never sell your data

This is a binding term of this agreement, not just a marketing line: OptOutHQ will not sell, rent, or share your personal information (in the sense of the CCPA/CPRA or any ordinary meaning of those words) to any third party for their own purposes. Our revenue comes entirely from subscriptions. We disclose your information only to the opt-out targets you direct us to, to the subprocessors listed in our Privacy Policy that operate the Service, or where required by law.

8. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. OptOutHQ does not provide legal advice.

9. Limitation of liability

To the fullest extent permitted by law, OptOutHQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

10. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms. On termination we delete your data as described in the Privacy Policy.

11. Changes and governing law

We may update these Terms; if a change is material we’ll notify subscribers by email before it takes effect, and the date above will change. These Terms are governed by the laws of the United States and the state in which OptOutHQ is established, without regard to conflict-of-laws rules.
